Terms of Service

1. Acceptance of Terms

By accessing or using Fade ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service. Fade is operated by Fade Technologies Inc.

2. Description of Service

Fade provides a barber management platform that includes appointment booking, calendar synchronization, payment processing (via Stripe), client management, SMS reminders, and related services. Payment processing is provided by Stripe, Inc. and is subject to Stripe's terms of service.

3. Subscription & Billing

3.1. Fade charges a flat monthly subscription fee as displayed on the pricing page. There are no per-transaction fees. Payment processing costs are covered by your subscription.

3.2. Subscriptions are billed monthly in advance. All fees are non-refundable except as expressly stated in this agreement or required by applicable law.

3.3. You may upgrade, downgrade, or cancel your subscription at any time. Upon cancellation, your subscription will remain active until the end of the current billing period.

3.4. Failure to pay may result in suspension or termination of access to the Service.

4. User Accounts

4.1. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

4.2. You must provide accurate, current, and complete information during registration and keep your account information updated.

4.3. Barbers and barbershops may create accounts. Each barber on a Team plan controls their own earnings and account settings.

5. Payment Processing

5.1. All payment processing is handled by Stripe, Inc. By using Fade's POS features, you agree to Stripe's Connected Account Agreement and Stripe's Terms of Service.

5.2. Fade does not store full credit card numbers. Payment information is tokenized and handled securely by Stripe.

5.3. Instant transfers are subject to a minimum amount and may be delayed in rare circumstances based on Stripe's processing times.

5.4. Chargebacks and disputes are handled by Stripe according to card network rules. Fade may deduct chargeback amounts from future payouts.

6. Cancellation Protection

Barbers may set a cancellation deadline for their services. Clients who book an appointment must provide a valid payment method. If a client cancels after the deadline or fails to show, the barber may charge a cancellation fee as specified in their cancellation policy. Fade is not responsible for resolving disputes between barbers and clients regarding cancellation charges.

7. Client Data & Privacy

Barbers who use Fade to manage client data are responsible for complying with applicable privacy laws. Fade collects and processes data as described in our Privacy Policy.

8. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable law
  • Attempt to circumvent any fee or subscription requirements
  • Impersonate any person or entity
  • Interfere with or disrupt the integrity or performance of the Service
  • Use the Service to engage in fraudulent, deceptive, or misleading activities

9. Limitation of Liability

To the maximum extent permitted by law, Fade Technologies Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service. Our total liability shall not exceed the total amount paid by you in the twelve (12) months preceding the claim.

10. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to merchantability, fitness for a particular purpose, or non-infringement. Fade does not guarantee that the Service will be uninterrupted, error-free, or secure.

11. Termination

Fade may suspend or terminate your access to the Service for violation of these Terms, non-payment, or conduct that we reasonably believe is harmful to the Service or other users. Upon termination, you must cease use of the Service and delete any related materials.

12. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes via email or through the Service. Your continued use after the effective date constitutes acceptance of the modified Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law provisions. Any disputes shall be resolved in the courts of New York County, New York.
